1. Acceptance of Terms

By accessing or using Actual Currents ("the Service"), including our website at actualcurrents.com and our mobile applications, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

2. Description of Service

Actual Currents provides tidal current predictions and visualizations based on oceanographic models. The Service includes free features and optional paid ("Pro") features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Not for Navigation

The predictions and data provided by Actual Currents are for informational and planning purposes only. They are not intended for navigation and should not be used as a substitute for official nautical charts, tide tables, or professional maritime advice. Always exercise sound judgment and consult official sources when making decisions that affect safety on the water.

4. Accuracy Disclaimer

Tidal current predictions are generated from harmonic models and may not account for all real-world conditions including but not limited to:

• Weather-driven currents (wind, storms, atmospheric pressure)
• Freshwater runoff and river discharge
• Unusual astronomical events
• Local obstructions or changes to waterways

We make no warranty regarding the accuracy, completeness, or reliability of any data or predictions provided through the Service.

5. User Accounts & Content

Some features may require creating an account via our authentication provider (Clerk). You may sign in using Google, Apple, or email magic link — no password is required. You are responsible for maintaining the security of your account. Any content you submit through the Service (including logs and photos) remains yours, but you grant us a license to store and display it as part of the Service.

6. Subscriptions & Billing

Free Tier: All core features are available for free with predictions limited to ±3 hours from the current time. No account is required for the free tier.

Pro Tier ($4.99/month or $39.99/year): Extended predictions with unlimited time range, current-optimized routing, and cloud sync. Requires an account.

• Billing: Pro subscriptions are billed monthly or annually via Stripe (web) or through Apple/Google in-app purchase (mobile). Payment is charged at the start of each billing period.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds for unused time.
• Price changes: We may change subscription pricing with 30 days' notice. Existing subscribers retain their current price until their next renewal after the notice period.
• Refunds: Refund requests within 7 days of initial purchase will be honored. Contact info@actualcurrents.com. App Store and Google Play purchases are subject to their respective refund policies.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or systematically download data from the Service
• Interfere with the operation of the Service or its infrastructure
• Misrepresent the source of data obtained from the Service

8. Intellectual Property

All content, design, code, and data models comprising the Service are the property of Actual Currents or its licensors. You may not reproduce, distribute, or create derivative works from any part of the Service without written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Actual Currents and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes, without limitation, damages for personal injury, property damage, lost profits, or data loss.

10. Indemnification

You agree to indemnify and hold harmless Actual Currents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
